Workshop on the Government Decree No. 80/2014/ND-CP on Drainage, Sewerage and Wastewater Treatment and Circulars for Decree Implementation

 The Administration of Technical Infrastructure - Ministry of Construction (MoC) and the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH* conduct a workshop to disseminate the three legal documents on drainage and sewerage on 15-16 June, 2015. The workshop takes place within the framework of the Vietnamese-German Wastewater Management Programme (WMP), implemented by GIZ in Viet Nam on behalf of the German Federal Ministry for Economic Cooperation and Development (BMZ).

The three legal documents are the Decree No. 80/2014-ND-CP (dated 6 August, 2014 by the Prime Minister of Vietnam on Drainage, Sewerage and Wastewater Treatment) and the two Circulars promulgated by the MoC, which  guide the Decree implementation, i.e. Circular No. 02/2015/TT-BXD (dated 2 April 2015 guiding the methodology on pricing wastewater services) and the Circular No. 04/2005/TT-BXD (dated 3 April, 2015 guiding the implementation of some articles of the Decree 80). All these documents have come into effect.  

The workshop brings together 150 participants: vice chairmen of province and city people’s committees; leaders and managers of functional units, the provincial departments of construction, the department of public works and transport, the departments of finance; wastewater companies; management units of industrial and of export processing zones; professional organizations; academies; and representatives from the relevant departments of the Ministry of Construction and the Ministry of Finance. In addition, representatives from Flood Proofing Project and Wastewater Programmes of Vietnamese-German development cooperation and Finnish-Vietnamese development cooperation take part in the event.

The participants of the workshop share lessons learned and discuss on the local regulations on wastewater management, operation and management contracts between the asset owner and the wastewater operator, how wastewater services are priced and collected in their provinces and cities… Dr Tim Mc Grath, Team Leader of the Advisory Team of WMP and some WMP provinces and cities, i.e. Bac Ninh, Tra Vinh, Soc Trang and Can Tho, presents and shares  experiences in the process to establish the lump-sum performance management contract. Starting from the existing challenges, recommendations in technical, financial, and governance aspects are given to the Ministry of Construction to improve the  implementation of the contract.

As a replacement of the Decree No. 88/2007/ND-CP (May 2007), the new Decree 80 on Drainage, Sewerage and Wastewater Treatment came into effect on January 1st, 2015.

‘After many years of successful cooperation with the MoC and the provinces, we are very happy to witness and contribute to the significant achievements and development in the wastewater sector in Viet Nam. The Decree 80, in particular, was considered as a breakthrough for the wastewater sector’ states Dr Dirk Pauschert, Programme Director of the Wastewater Management Programme (WMP). He further explains that the Decree had introduced modern principles, concepts and important regulations in the wastewater sector such as regulations on the wastewater service price, operation and management of contracts, the connection of households to the wastewater system, preferential investment policies, provincial regulations, reuse of stormwater and treated wastewater, sludge management, and decentralized wastewater treatment… The encouraging results of the national survey jointly conducted by GIZ and the MoC on the Decree could be seen as an evidence for the expected strong impacts of the Decree in efficient and sustainable development of the wastewater sector in Vietnam, declares Dr Pauschert.

Dr Nguyen Hong Tien, Director General of the Administration of Technical Infrastructure, MoC, asserts that ‘the introduction of wastewater service price in replacement of the wastewater fee is the fundamental change in the Decree 80. The relevant regulations on wastewater service prices cover objects for application, principles, methodology and responsibility for development, appraisal and decision on the price’. On the other hand, through payment of the user charge, the people would save clean water and reduce wastewater discharge into the drainage and sewerage system – what would also contribute to environmental protection, he adds. Moreover, the wastewater service companies would have higher responsibility in improving service quality to meet the requirements of the users.

Ms. Thao Huong, Head of the Wastewater Management Division under ATI says “one third of the provinces and cities in Vietnam had issued local regulations on drainage and sewerage management  under different names and inconsistent contents before the promulgation of the Decree 80”. She added that the provinces and cities that had issued local regulations on drainage and sewerage management should review, amend and adjust the lregulations in line with the Decree and to respond to local conditions while the remaining cities and provinces should base on the Decree and local conditions to develop their own local regulations.

The leadership of wastewater management companies added that the Decree 80 and its two Circulars will help to gradually bridge the financial gap between income raised by the wastewater charge and the costs for  operation and maintenance of wastewater infrastructure. In Soc Trang for example, the income from wastewater charge collected from the users currently covers only 35% of the total operation and maintenance costs, including  the depreciation of mechanical and electronic equipment.

After the workshop, the participants joined a technical visit to Phu Loc Wastewater Treatment Plant under the operation of Da Nang Drainage, Sewerage and Wastewater Treatment Company.

On 18 June, Dr. Nguyen Hong Tien - ATI General Director, MoC and Dr. Dirk Pauschert, GIZ Programme Director had a meeting with Ms. Phan My Linh, Vice Minister of Construction to report to her the results of the workshop and propose the next steps in faciliating enforcement of these legal documents.
